1. Introduction

Welcome to Benefitty ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the Benefitty mobile application and website (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time. Your continued use of the Service following any changes constitutes your acceptance of the revised Terms.

2. Eligibility

To use the Benefitty Service, you must:

  • Be at least 18 years of age or the age of legal majority in your jurisdiction;
  • Have the legal capacity to enter into binding contracts;
  • Not be prohibited from using the Service under applicable laws; and
  • Be a verified resident or tenant of a residential property or development that has entered into a partnership agreement with Benefitty.

By registering for an account, you represent and warrant that you meet all eligibility requirements. Benefitty reserves the right to verify your eligibility at any time and to suspend or terminate your account if eligibility criteria are not met or cease to be met.

3. Nature of the Service

3.1 Aggregation Platform

Benefitty is a benefits aggregation and discovery platform. We source, curate, and present deals, discounts, and offers from third-party retail and service partners ("Offer Partners") in one convenient location for eligible residents. We act as an intermediary platform only.

3.2 No Guarantee of Exclusivity or Uniqueness

Whilst we strive to negotiate preferential terms for our users and to surface offers that provide genuine value, we do not represent or warrant that:

  • Any offer, deal, or discount available through the Service is available exclusively through Benefitty or is unavailable elsewhere;
  • Any offer represents the best available price or terms in the market;
  • Any offer is tailored solely or specifically to Benefitty users.

The value of the Service lies in the curation, aggregation, and convenient presentation of offers relevant to residents — not in any guarantee of exclusivity. Any reference in our materials to "exclusive" or "members-only" deals refers to the access mechanism (i.e. resident-verified access) and not necessarily to the underlying pricing or availability of those offers.

3.3 Offer Descriptions and Marketing Materials

We take reasonable care to ensure that descriptions of offers and benefits on the Service are accurate and not misleading. However:

  • Offer details, including pricing, discount amounts, terms, and availability, are provided to us by Offer Partners and are subject to change without notice;
  • Estimated savings figures (e.g. "Save up to £X") are illustrative and based on a comparison with standard retail pricing at the time of publication; actual savings will vary by user and purchase;
  • We are not responsible for inaccuracies in offer descriptions that arise from information provided to us by Offer Partners;
  • You should verify current offer terms directly with the relevant Offer Partner before making any purchase decision.

Nothing in our marketing materials or in the Service constitutes a binding offer, representation, or warranty as to the value of any benefit you will receive.

4. Account Registration and Security

4.1 Account Creation

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary to keep it accurate and complete.

4.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@benefitty.co.uk of any unauthorised use of your account. We will not be liable for any loss or damage arising from your failure to comply with these obligations.

5. Use of the Service

5.1 Licence Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial use only.

5.2 Restrictions

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations;
  • Reproduce, distribute, modify, or create derivative works of the Service or its content;
  • Reverse engineer, decompile, or disassemble any component of the Service;
  • Use automated systems (including bots, scrapers, or crawlers) to access the Service;
  • Attempt to gain unauthorised access to any portion of the Service or its related systems;
  • Interfere with or disrupt the integrity or performance of the Service;
  • Share, sell, transfer, or otherwise make available your account credentials or any offer codes to third parties; or
  • Use the Service to commit fraud or to abuse any offer or discount.

6. Offers, Deals, and Third-Party Partners

6.1 Availability

Benefitty provides access to deals and offers from Offer Partners. All offers are subject to availability and to the terms set by the relevant Offer Partner. Offers may be modified, withdrawn, or suspended at any time without prior notice. We do not guarantee the continuous availability of any offer, and the inclusion of an offer on the Service at any time does not create any obligation on us or the Offer Partner to honour that offer in perpetuity.

6.2 Third-Party Terms and Responsibility

All offers are provided by third-party Offer Partners and are subject to their respective terms and conditions, returns policies, and applicable laws. By redeeming an offer, you enter into a direct relationship with the relevant Offer Partner. Benefitty is not a party to that transaction and accepts no responsibility for:

  • The quality, safety, legality, fitness for purpose, or delivery of any product or service obtained from an Offer Partner;
  • Any failure by an Offer Partner to honour an advertised offer or discount;
  • Any dispute between you and an Offer Partner arising from a transaction;
  • Any changes to an offer's terms after it has been published on the Service.

Your sole remedy in respect of any dissatisfaction with a product or service obtained via the Service lies against the relevant Offer Partner, not Benefitty.

6.3 Personal Use Only

All offers and promotional codes made available through the Service are for your personal use only. You may not resell, transfer, or use them for commercial purposes. Violation of this restriction may result in immediate termination of your account and, where applicable, legal action.

6.4 Limitations and Conditions

Offers may be subject to geographic restrictions, quantity limits, minimum spend thresholds, expiry dates, and other conditions specified by the relevant Offer Partner. Benefitty reserves the right to limit the number of offers you may redeem.

6.5 No Endorsement

The inclusion of any Offer Partner, product, or service on the Service does not constitute an endorsement or recommendation by Benefitty of that partner, product, or service.

6.6 General Conditions by Offer Type

Where an offer on the Service links to these Terms for applicable conditions, the following general conditions apply by offer type. These conditions apply in addition to any terms set by the relevant Offer Partner and are intended as a general guide only. You should always check the Offer Partner's own website for the most current and complete terms before making a purchase.

Discount and Promotional Codes

  • Codes are valid for single use only unless otherwise stated.
  • Codes are for personal use only and may not be shared, resold, or transferred.
  • Codes are valid on full-price items only unless the offer expressly states otherwise.
  • Codes cannot be combined with other promotional offers, discount codes, or sale pricing unless stated.
  • Minimum spend thresholds may apply; these will be indicated on the offer tile where known.
  • Codes are subject to availability and may be withdrawn without notice.
  • Benefitty accepts no responsibility if a code fails to apply at checkout; in the first instance contact the relevant retailer.

Limited Time and Expiry-Based Offers

  • Where an end date is displayed on an offer tile, the offer is intended to expire on that date; however, Offer Partners may withdraw or extend offers at any time without notice.
  • Where no end date is displayed, the offer is open-ended and subject to withdrawal at any time.
  • Benefitty endeavours to remove expired offers promptly but cannot guarantee real-time accuracy of offer availability.
  • Redeeming an offer close to its stated expiry date is at your own risk; we recommend checking availability on the Offer Partner's website before completing a purchase.

Free Delivery and Threshold-Based Offers

  • Free delivery offers are subject to minimum basket values as specified by the Offer Partner.
  • Free delivery thresholds and eligible delivery zones are set by the Offer Partner and may change without notice.
  • Free delivery offers apply to standard delivery only unless expressly stated; express, next-day, or international delivery may be excluded.
  • Offer applies to selected items only where indicated; the Offer Partner's website is the definitive source of eligible products.

Cashback and Commission-Based Offers

  • Cashback rates and commission structures are set by the Offer Partner and are subject to change without notice.
  • Cashback or rewards, where applicable, are typically excluded on sale items, gift cards, delivery charges, and taxes unless otherwise stated.
  • To qualify, purchases must be made by following the link directly from the Benefitty platform; purchases made by navigating to a retailer independently will not qualify.
  • Cashback and rewards may be subject to a validation or approval period as determined by the Offer Partner.
  • Benefitty accepts no liability for cashback or rewards that are declined, adjusted, or reversed by an Offer Partner.

Curated and Resident-Specific Offers

  • Certain offers on the Service have been specifically negotiated by Benefitty on behalf of its verified resident user base and are accessible via the platform only.
  • Access to these offers is conditional on maintaining a valid, verified Benefitty account; offers will not be accessible if your account is suspended or your eligibility lapses.
  • These offers are made available as a resident benefit only and do not form part of any tenancy, employment, or membership agreement.
  • Offer terms, including duration and discount levels, are subject to change at the discretion of the Offer Partner; Benefitty will endeavour to update the platform promptly where material changes occur.

7. Distribution Partners

7.1 Types of Distribution Partners

Benefitty makes the Service available to eligible users through a range of third-party distribution relationships ("Distribution Partners"). Distribution Partners may include, without limitation:

  • Residential property operators, build-to-rent operators, landlords, and residential management companies ("property operators");
  • Employers and employee benefits platforms offering the Service as a workplace benefit;
  • Government bodies, local authorities, and public sector organisations making the Service available to residents, citizens, or staff;
  • Property developers and housebuilders offering the Service as part of a new-build or development amenity package;
  • Asset managers and investment vehicles with interests in residential, commercial, or mixed-use property;
  • Housing associations, registered providers, and social landlords;
  • Membership organisations, professional bodies, and affinity groups; and
  • Any other entity that has entered into a commercial partnership agreement with Benefitty to distribute access to the Service.

The above list is illustrative and non-exhaustive. Benefitty may enter into Distribution Partner arrangements with any organisation at its discretion.

7.2 Role of Distribution Partners

Distribution Partners facilitate or enable access to the Service for their residents, employees, members, customers, or other eligible groups. In doing so, they act solely as a conduit for access. Distribution Partners are not responsible for, and make no representations regarding:

  • The content, accuracy, or availability of the Service or any offer featured on it;
  • The conduct or obligations of Benefitty or any Offer Partner;
  • Any transaction, contract, or dispute arising between you and an Offer Partner; or
  • Any loss or damage arising from your use of the Service.

7.3 Service is an Amenity Only

Access to the Service provided through a Distribution Partner is offered as an additional amenity or benefit only. It does not:

  • Form part of any tenancy agreement, lease, employment contract, membership agreement, or other contractual arrangement between you and the Distribution Partner;
  • Give rise to any rights or obligations under such arrangements;
  • Constitute a term or condition of any licence, permit, or consent granted by a Distribution Partner; or
  • Create any liability on the part of the Distribution Partner for the Service or its content.

Any reference by a Distribution Partner to Benefitty or the Service in their own marketing, signage, or resident/employee communications is for informational purposes only and does not amount to an endorsement, guarantee, or warranty of the Service or any offer.

7.4 No Liability of Distribution Partners

To the fullest extent permitted by applicable law, Distribution Partners (and their respective officers, directors, employees, agents, and affiliates) shall have no liability whatsoever to you arising out of or in connection with the Service, any offer, or any transaction with an Offer Partner, whether in contract, tort (including negligence), or otherwise.

7.5 Changes to Distribution Partnerships

Benefitty's relationship with any Distribution Partner may change or terminate at any time, for any reason. If the arrangement with your Distribution Partner ends, your eligibility to access the Service may be affected. We will endeavour to provide reasonable advance notice where practicable, but are not obligated to do so. Termination of a Distribution Partner arrangement shall not create any claim against Benefitty or the Distribution Partner.

8. Payment

The Service is currently provided at no cost to eligible users. If we introduce paid features in the future, we will provide advance notice and additional terms. Purchases made directly with Offer Partners are governed solely by the relevant Offer Partner's payment and refund policies.

9. Intellectual Property Rights

9.1 Ownership

The Service and all content, features, and functionality — including but not limited to text, graphics, logos, icons, images, data compilations, and software — are owned by or licensed to Benefitty and are protected by copyright, trade mark, and other intellectual property laws.

9.2 Trade Marks

"Benefitty" and associated logos are trade marks of Benefitty. You may not use our trade marks without our prior written consent. All other trade marks appearing on the Service are the property of their respective owners.

10. User Content

If you submit feedback, reviews, suggestions, or other content to us ("User Content"), you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable licence to use, reproduce, modify, publish, and distribute such User Content in any media. You represent and warrant that you own or have the necessary rights to submit the User Content and that it does not infringe any third-party rights.

11. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of your personal information as described in the Privacy Policy.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY.

In particular, we make no warranty that:

  • Any offer, discount, or saving described on the Service will be available, honoured, or achievable;
  • The Service will be error-free, secure, or continuously available;
  • Any content or information on the Service is accurate, complete, or up to date; or
  • The Service meets your specific requirements or expectations.

To the extent permitted by law, Operator Partners also provide no warranty in connection with the Service.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEITHER BENEFITTY NOR ANY OPERATOR PARTNER SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR ANTICIPATED SAVINGS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed £100 or the amount you have paid us in the twelve (12) months preceding the claim, whichever is greater.

Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Benefitty, its affiliates, Operator Partners, and their respective officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your violation of these Terms;
  • Your use of the Service;
  • Your violation of any applicable law or regulation; or
  • Your infringement of any third-party rights.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Your right to use the Service will cease immediately upon termination. You may close your account at any time by contacting us at support@benefitty.co.uk. Provisions that by their nature survive termination — including ownership, disclaimers, indemnity, and limitations of liability — shall continue to apply.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales.

16.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be addressed through good faith negotiations. If unresolved within thirty (30) days, disputes shall be referred to binding arbitration under the rules of the London Court of International Arbitration (LCIA).

16.3 Jurisdiction

For disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the courts of England and Wales.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Benefitty regarding the Service and supersede all prior agreements or understandings.

17.2 Waiver and Severability

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision. If any provision is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17.3 Assignment

You may not assign these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

17.4 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, network failures, civil emergencies, or government action.
